Terms of Agreement

This Service Agreement (“Agreement”) is entered into between Cool Pools LLC (“Service Provider”) and the undersigned customer (“Customer”). Customer agrees to retain Cool Pools LLC for recurring pool maintenance services under the terms set forth below.

This Agreement is a month-to-month service contract. Customer agrees to pay all monthly fees in advance of services rendered. Either Party may terminate this Agreement pursuant to Section 11.

Cool Pools LLC will provide maintenance services once per week at the Customer’s service address. Customer may request additional pool cleaning service during storms or monsoon season for an additional charge.

Cool Pools LLC will assign the service day. Service days may be adjusted at the Service Provider’s discretion.

• Cool Pools LLC may postpone service due to weather, illness, holidays, or other circumstances.
• Service may be postponed up to four (4) weeks per calendar year.
• No service will be performed during: Thanksgiving week; Christmas week; and two (2) off-season weeks (Customer notified in advance).
• During inclement weather (storms & heavy rain) only essential tasks will be performed (chemical balancing, basket checks).

Cool Pools LLC will make reasonable efforts to return emergency and after hour calls and emails. Emergency services are billed separately at a rate quoted on a case-by-case basis.

1. Cool Pools LLC will perform the following weekly pool cleaning services:

• Skim pool surface and floor
• Backwash filter as needed
• Clean leaf baskets
• Clean pump baskets
• Inspect equipment operation
• Brush pool walls
• Test and balance water
• Vacuum pool as needed

Customer Requirements

• A functioning in-floor cleaning system or suction-side cleaner is required.
• Customer must maintain proper water level (recommended: mid-tile).
• Basic Chemicals are included in the base rate (all chlorine, muriatic acid, soda ash, bicarb

•  Repairs are not included in the monthly service fee.
• Repairs under $60 may be completed without prior approval and billed to Customer.
• Repairs over $60 require Customer authorization before work begins.

Customer agrees to pay:

• Monthly service fee
• Additional charges for chemicals, repairs, or extra labor
• Filter cleaning every 6 months (excluding sand filters)
• Pool draining and startup will be performed every 24 months to help control TDS hard water & high CYA levels.

1. Payment methods and terms:

• Payments can be made via the invoice sent to your email.
• Checks (payable to Cool Pools LLC) and cash may be left for pick up in an envelope in the pool equipment area on service day.
• We bill on the 1st of every month; payment is due no later than the 5th of the same service month.
• A $15 late fee applies to all late payments.
• If payment is not received by the 6th of the month, services will be paused until payment is made.

1. Cool Pools LLC is not responsible for damage caused by:

• Weather, fire, vandalism, misuse, or abuse
• Normal equipment deterioration due to chemicals, sunlight, or age
• Customer’s failure to maintain proper water levels
• Customer’s failure to follow recommended maintenance
• Surface deterioration (plaster, quartz, pebble, etc.) due to age or chemical exposure

Customer acknowledges that proper maintenance requires cooperation between visits.

This Agreement may be terminated by either Party at any time. Customer agrees to continue service through the end of the current paid service month.
